These Terms of Service ("Terms") govern your access to and use of the Lone Nut Kaizen application and services ("Service"), operated by Lone Nut Kaizen ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.
We may, at our sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial"). You may be required to enter your billing information in order to sign up for the Free Trial. If you do enter your billing information when signing up for the Free Trial, you will not be charged by us until the Free Trial has expired. On the last day of the Free Trial period, unless you canceled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
Lone Nut Kaizen, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
Subscriptions. We offer a no-questions-asked 30-day money-back guarantee on Lone Nut Kaizen subscriptions. The 30-day window is measured from the date you first signed up for the Service (i.e. the start of your free trial or, if you did not take a trial, the date you first subscribed). Within that window you may request a full refund of your most recent subscription invoice, and your subscription will be canceled immediately.
Refunds within the 30-day window can be requested directly from Settings → Billing using the "Cancel & request refund" control, which processes the refund and cancellation automatically. After the 30-day window has passed, subscription payments are non-refundable; you may still cancel your subscription at any time and you will retain access until the end of your current billing period. The 30-day money-back guarantee is limited to one self-service refund per customer, identified by either email address or payment card; subsequent self-service refund requests will be declined and routed to support for case-by-case review.
AI Action Packs. Top-up AI Action Packs are one-time purchases of digital credits delivered immediately to your organization's account. Because the credits are consumable and granted on purchase, AI Action Packs are non-refundable. We may, in our sole discretion and on a goodwill basis, consider a refund where a pack was purchased clearly in error and none of the credits have been used; such requests should be made to support@lonenutkaizen.online within 7 days of purchase. Where a goodwill refund is granted, the corresponding credits will be revoked from your organization's balance.
The Service and its original content, features, and functionality are and will remain the exclusive property of Lone Nut Kaizen and its licensors. The Service is protected by copyright, trademark, and other laws of both New Zealand and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Lone Nut Kaizen.
You may use the Service only for lawful purposes. You may not use the Service:
The Service includes AI-powered features (collectively, "KAI") such as — depending on your subscription tier — the AI Insight Engine, AI-Assisted Process Mapping, Digital Twin Monte Carlo Simulation, Kaizen Culture Monitoring, the 5 Whys assistant, the AI Process Auditor, and any other feature that generates content using a large language model. KAI is built on third-party generative AI models (currently Google's Gemini family, accessed via the Genkit framework) and operates on the inputs you provide.
AI outputs are provided as guidance and inspiration only — not as absolute, authoritative, or guaranteed-correct answers. Generative AI can produce information that is inaccurate, incomplete, biased, out of date, or fabricated ("hallucinated"). You acknowledge and agree that:
To the maximum extent permitted by law, Lone Nut Kaizen makes no warranty, express or implied, regarding the accuracy, reliability, completeness, fitness for purpose, or non-infringement of any AI-generated output, and disclaims all liability for losses arising from your reliance on it. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
In no event shall Lone Nut Kaizen, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
